Haftung in der Partnerschaftsgesellschaft mit beschränkter Berufshaftung

The paper "Liability in the partnership with limited professional liability - with special consideration of recourse issues" deals with the German partnership with limited professional liability (PartGmbB), a company form only for freelancers, in which the limitation of liability is based on the conclusion of a professional liability insurance. The focus of the work is on a PartGmbB consisting of lawyers and the particularities of the law of the legal profession. While the external law of the partnership is relatively clearly regulated, there are numerous unresolved questions regarding the internal relationship between the company, its partners and the insurance company. The thesis deals in depth with the legal possibilities of recourse and evaluates the effectiveness of the limitation of liability. Furthermore, it gives advice on the drafting of the articles of association.
