Who is liable when goods are damaged in a multi-tier carrier chain? This dissertation examines four key liability problems arising from the interplay of main and sub-carriage contracts. The starting point is the entitlement of consignor and consignee to compensation under the main carriage contract pursuant to sections 425 and 437 of the German Commercial Code (HGB). Building on this, the study critically analyzes whether the original consignor and the final consignee may also assert claims under the sub-carriage contract by means of general civil law instruments. At its core, the work offers a thorough critique of the German Federal Court of Justice's revised case law from 2008 and 2010.
