Harmonisierung und Risikoregulierung von Technik, Betrieb und Gesamtsystem der Eisenbahn in Europa

The functional interconnection of the different railway systems in the Member States to form a single European railway area without falling below the existing high level of safety – this is the challenge of the EU railway law of the "technical pillar". In this work, the author examines the system of EU regulation and the inherent scope for special characteristics in the Member States. This reveals not only specific regulatory approaches, but also conflicts with the requirements of the EU level in the context of the “national rules” remaining within the jurisdiction of the Member States and, not least, constitutional distortions.
