Conditionality in the form of Regulation 2020/2092 is an attempt to protect the European budget from violations of the rule of law in European member states. When can a link be established between the rule of law and the European budget? What legal framework must be taken into account when establishing such conditionality? How should measures against European member states be designed? The author addresses these and other questions and attempts to shed light on the limits of budgetary protection against violations of the rule of law. In doing so, he establishes a link to Regulation 2020/2092 and evaluates it.
