Universities need to balance the (admin) tasks they perform on behalf of the state and the self-governing science tasks. The exact design of the governance of the university at the central and decentral level decisively determines the success of a university as well as the participation of the university members and the freedom of the scientists.
The authors give an overview of fundamental questions of university governance and the constitutional and legal framework. Using the example of a university of applied sciences in Berlin based on the amendment of the Higher Education Act in Berlin, the authors discuss the legal requirements and possibilities for the individual institutions, also in comparison with the regulations of other federal states.
