Indirekte Horizontalverflechtungen zwischen Wettbewerbs-, Kapitalmarkt- und Aktienrecht

Can parallel shareholdings within a market weaken competition? This question is debated among legal scholars and economists as „Common Ownership“. This title examines whether and how minority shareholdings in competing undertakings by institutional investors, in particular the “Big Three” asset management firms, can have anticompetitive effects. The thesis discusses which barriers existing competition, capital markets and corporate laws draw for such effects, as well as what a future legislative solution might look like. It includes the current theoretical and empirical economic research on the subject.
