Description
“The government has violated the parliament in its rights.” Every member of government fears giving cause to such an assessment. Especially in the area of parliamentary informational rights and obligations, the constitutional judicature is characterised by its large number of judgements. This field is not terra incognita; however, the string of new lawsuits does not seem to die down. This paper provides a systematic overview of well-known sets of problems and their constitutional localisation. Examples demonstrate the informational rights of parliamentarians vis-à-vis the government and illustrate their restrictions, which can cause the transmission of information to be suspended in individual cases. Although the focus is put on legal practice in the Free State of Saxony, the analysis is applicable to the federal states as well as to the relationship between the Bundes-tag and the federal government due to comparable structures.
