An effective cross-border cooperation of police and justice authorities is essential to providing freedom, security and justice. The European legislator recently shifted its focus to facilitating and improving the cross-border exchange of information and personal data. The so-called Swedish framework decision, the Prüm decision and the Directive regarding the European Investigation Order contribute to this objective. However, the present analysis reveals a considerable need for action in respect of the fundamental right to data protection. The framework decision regarding the protection of personal data was not sufficient, both in terms of timing and content. Moreover, the highly fragmented legal order on to the cross-border exchange of information and the cooperation with third states need to be consolidated.
