Inhalt und Grenzen der Vermieterpflichten gem. § 535 Abs. 1 S. 2 BGB

This study examines content and scope of a lessor's obligations under sec. 535 subsec. 1 sent. 2 German Civil Code (BGB), addressing issues also of practical significance. The obligations are analyzed both in relation to one another and in relation to the obligation under sec. 535 subsec. 1 sent. 1 BGB. Since this work lies at the intersection of tenancy law and general contract law, it examines issues of warranty law under tenancy law (in particular the concept of deficiency used there) as well as possible limitations under general contract law regarding performance issues (Secs. 275, 313, 314 BGB). The study is guided by the thesis that the lessor's condition-related obligations are, by their very nature, not unlimited.
