Description
The work examines the claim for supplementary performance under the German Law of Sales, focusing on the cases of removal and installation. The author deals in each case with the relevant requirements of European Law as well as the new regulations in the Law of Sales coming into force on January 1, 2022. The prerequisites and legal consequences of the claim under Section 439 (3) of the German Civil Code are discussed in detail. In particular, the author examines one of the currently most controversial questions in the Law of Sales, namely whether, in addition to the claim for reimbursement of expenses, there is also a claim for removal and installation by the seller. Furthermore, the claim is placed in the dogmatics of warranty rights.
