This work examines the conflict between the collective bargaining capability of guilds and guild associations and the statutory regulation by the Handwerksordnung and its public law provisions. It begins with a look at the collective bargaining practice in the crafts sector, followed by an examination of basic constitutional issues, such as the coalition status of these organisations. From the perspective of labor law, highly practice-relevant questions of collective bargaining law are addressed, which exemplarily offer solutions for emerging legal problems in this area of conflict. Here, for example, the limits of the collective bargaining power of the guild associations were determined. The author is a lawyer specializing in labor law.
