Institutionalisierte Partnerschaften der öffentlichen Hand im Fokus des Beihilferechts

Although institutionalised partnerships of the public sector are at the interface between State aid law and public procurement law, State aid law – which is applicable alongside public procurement law – has so far remained in the shadows in the discussion on this form of public-private cooperation. In her book, the author examines the performance of public tasks by mixed-economy and mixed-public joint ventures with special consideration of exclusive and special rights under EU State aid law. On this basis, she develops guidelines for the design of institutionalised partnerships of the public sector in compliance with EU State aid law.
