Broadcasting is business. As commerce, broadcasting trade is governed by economic law, calling for free trade principles. At the same time, broadcasting is culture. Some states are therefore reluctant to open their culture to global competition. Regulation of international broadcasting trade has had to take resulting tensions into account. The author has used the dispute surrounding the EC quota for "European Works" to illustrate the economic and legal principles governing international broadcasting trade. Economic theory may explain why the US programme industry competes so successfully. The author explores possible specific approaches for measures to protect broadcasting industries within the framework of WTO-law. In separate chapters he analyses whether broadcasting is to be considered a good or a service and establishes the Community"s regulating powers. The author then treats aplicable primary and secondary Community law in detail, before finally commenting on conflicts of the quota provision with EC- or WTO-law.
