Irrelevanz im Umweltrecht

In the first part of the work in environmental law, Malte Pickhardt examines how background mechanisms regarding the drawing of boundaries in law explain and justify the idea of irrelevance. Dealing with semantic vagueness is one point of reference, while the shortcomings in setting limit values are another. This interplay of mechanisms in dealing with undefined legal terms and the rules on irrelevance leads to the proposal for a more precise terminology. In the second part, the points of reference for the idea of irrelevance in positive law are identified. At the same time, an alternative solution is proposed for the problem of summation, which is omnipresent when dealing with rules on irrelevance.
