Justizfähigkeit von Individualrechten

As most of us probably do, Heinrich von Kleist’s Michael Kohlhaas knows very well what it means to be right without being proven right. A feeling of outrage and powerlessness often remains, in particular towards the state monopoly on the use of force. Of course: The judiciary system cannot always be error-free. But at least, it always must provide a possibility of obtaining justice right where individual rights might be infringed. This meanwhile requires that a (primarily) legal and therefore rationally understandable scope of measurement will be applied.

This undoubtedly leads to the core of our understanding of the rule of law. By revealing various historical and systematic lines of development, this volume also makes a contribution to the current concept of the rule of law and the protection of individual rights.
