Corporate restructuring in the case of companies that are listed at a German stock exchange raises numerous questions in the field of Corporate, Insolvency and Capital Markets Law. Taking into account the latest reform of German Insolvency Law this work is the first to deal comprehensively with these practically important matters. It analyses the current legal framework and makes a significant contribution to the clarification of the complex and yet unresolved issues specifically concerning the disposal of the assets of the business as a going concern or the financial reorganisation of the company itself within insolvency proceedings.
Furthermore, the work assesses the current legal regime with regard to a need for reform and draws up regulatory proposals which would eliminate obstacles that hamper the restructuring process at present.
