Kartellrechtliche Grenzen der Preisberatung

This thesis analyses recent developments in the liability of consultants and their clients for competition law infringements under German and EC competition laws in trilateral or multilateral situations. The applicable legal standards are derived from case law, especially from recent landmark decisions of the ECJ, while also taking previous practices on the national level into consideration. The found legal standards are then applied to different constellations of price consulting as a specialized form of business consulting services. In doing so the author also discusses gaps in the current liability framework and potential solutions to effectively prevent third party cartel facilitation in the future.
