Kartellschadensersatz bei Missbrauch einer beherrschenden Stellung auf den Postmärkten

The antitrust damages regime codified in the German Competition Act (GWB) allows civil courts to review unilateral conduct by dominant undertakings. This type of judicial control differs significantly from the oversight exercised by the Federal Network Agency over companies in the postal markets. As a result, independent and parallel enforcement of antitrust damages claims has the potential to create tensions with the Agency’s regulatory supervision. This may hinder the achievement of the objectives of postal regulation. Using the classical legal-dogmatic approach, this thesis examines the extent to which postal law affects the enforcement of antitrust damages claims within its scope.
