Efficient private antitrust enforcement is hardly conceivable without effective rules governing disclosure of evidence. The Directive 2014/104/EU intends to establish a uniform basis for disclosure, but remains silent on practical aspects such as the protection of trade secrets or the costs. The book, written within the framework of a Franco-German doctoral programme, compares the rights of inter partes disclosure in Germany and France. It looks in particular at the practicability of the rules, the equivalence of protection and highlights the most efficient and favourable legal system for claimants and defendants; concrete reform proposals are submitted.
