Follow-on cartel damages proceedings concern a large number of German courts, which have to compete with other forums for effective proceedings. This raises the questions of what actually determines the effectiveness of such proceedings and how Germany is doing in this respect as a forum. To answer these questions, the author conducted a survey among lawyers to determine the decisive parameters. In order to establish a status quo for these parameters, this is followed by a practical analysis of, among others, all decisions published in the period under review, as well as a presentation of possible impulses for increases in effectiveness from the established forum England.
