In light of the growth of large online platforms, assessing the liability of hosting providers in the field of personality rights requires a shift towards greater responsibility for content moderation. The core criterion of provider liability in the EU, Germany, and China is knowledge of an infringement. Yet identifying such violations is difficult, as it requires balancing personality rights against freedom of expression. This dissertation proposes conceptualizing knowledge as a two‑stage obligation within a duty‑of‑care‑based liability framework, aiming to balance the interests of rights holders, users, and platforms while encouraging the development of automated moderation technologies.
