Description
'Klimaschäden im Privatrecht' examines whether greenhouse gas emitters can be held liable for climate-related damage. In addition to fundamental questions of constitutional law and private international law, the dissertation addresses the problem of causation as well as the issue of liability for lawful conduct. It also considers whether neighbour-law provisions can be applied in climate litigation. A broader issue in climate liability claims is the question of the limits of judicial lawmaking. The author adopts a liability-sceptical position, not least because drawing the boundaries of climate liability cannot be achieved without a substantive loss of justice.
