Klimaschutz vor Gericht

The dissertation examines whether individuals have legal standing to sue the German government for more ambitious climate protection programs pursuant § 9 Abs. 1 KSG. It analyzes the relevant legal foundations in national, European and international climate protection law and examines the implications of the German Federal Constitutional Court´s climate protection decision on administrative court proceedings. Particular emphasis is placed on the classical functions of fundamental rights, the fundamental right to the ecological minimum subsistence level and the new intertemporal dimension of fundamental rights.
