Klimaschutzrecht durch den Energiesektor im Mehrebenensystem

Based on a comprehensive empirical analysis, this study examines in depth the legal significance of the concept of “climate.” The evaluative benchmark is whether existing climate protection law is effective in guiding the energy sector. The focus is a comparative analysis of the multilevel system comprising international law, EU law, and national law. Structural deficiencies and legal fragmentation that undermine the effectiveness of the regulatory framework are identified. The study further develops practicable approaches for a flexible, robust, and economically viable climate protection regime. The objective is a forward-looking legal framework that incentivizes investment, ensures stakeholder acceptance, and delivers an effective contribution to global climate protection.
