This work provides legal scholars, patent experts, and policymakers with a concrete dogmatic framework on how European patent law can be effectively leveraged as a regulatory instrument against climate change—ranging from the targeted restriction of climate-damaging technologies to the accelerated dissemination of green innovations. Grounded in constitutional (Art. 20a GG), European and international law, Chiara Kusch develops an ecological interpretation of the patent system. Applying legal dogmatics and patent law justification theories, she examines, among other aspects, the grounds for exclusion from patentability (Art. 53(a) EPC) and the disclosure of life cycle assessments under Art. 83 EPC.
