Kommerzialisierungsfester Datenschutz

Often data are called the ‚oil of the 21st century‘. They are crucial for the added value of many business models in the information economy. Especially personal data become de facto assets without the law reacting to this development significantly. This present work examines how this trend of commerzialization could and should be acknowledged by law in general and information privacy law specifically, in order to protect data subjects from economical disadvantages and an excessive loss in their privacy. Besides consequences for anti-trust law this work focusses in particular on contract law and discusses a possible property law regarding data.
