This book is the first to subject the competitive relationships in criminal law practice in the case of illicit trafficking in narcotics to an in-depth scientific examination. The focus is on the examination of competition in the case of illicit trafficking in narcotics and the related offenses of the BtMG. For this purpose, the occurring competitive relationships are presented in their entire range, and the solutions offered by case law are examined and critically scrutinized, taking into account the dogmatic background of the respective form of competition. For the first time, the book offers the criminal lawyer a "checklist" for solving the diverse and sometimes confusing cases.

»Der große Verdienst der Abhandlung Patzaks liegt darin, die Rechtsprechung des BGH (v.a. die neueren Entwicklungen) dokumentiert und so übersichtlich ›eingeordnet‹ zu haben, wie es eben geht: Nirgendwo sonst (auch nicht in den einschlägigen Kommentaren, nicht einmal im »Patzak« selbst) findet man eine derart ausführliche, aber zugleich auch klar strukturierte, zusammenhängende Darstellung. Zudem ist Patzak stets um eine klare Zuordnung der Fallgruppen bemüht, achtet penibel auf die Terminologie, und nennt hierbei zahlreiche Beispiele, in der die Rechtsprechung dies leider nicht tut. Insgesamt ermöglicht die akribische Auswertung Patzaks zumindest das Herausfiltern von »eindeutig unproblematischen« Fallgruppen und gibt einem das Gefühl, die Konkurrenzlehre folge passagenweise nachvollziehbaren Regeln. Zweifelsohne eine lesenswerte und wissenschaftlich verdienstvolle Arbeit, an der Theorie und Praxis gleichsam nicht vorbeikommen werden, wenn – wie zu prognostizieren ist: auch in Zukunft sehr häufig – die Konkurrenzverhältnisse beim unerlaubten Handeltreiben mit Betäubungsmitteln in den Blick zu nehmen sind.«
