Description
According to the related-persons-case-law, loan collateral provided by relatives of a borrower is immoral if they are blatantly financially overburdened and have no self-interest in the loan. An exploitation of emotional bond by the creditor is presumed. This handling of the federal court is presented in full. In addition, a number of suggestions for improvement are made, for example on the calculation of the blatant financial overload and on the requirement of a close personal relationship. In addition, the limits of the scope of application are defined, in particular with regard to consumers as creditors or to mortgages as well as loan agreements instead of personal securities.
