The enforcement of the prohibition of cartels under EU law pursuant to Article 101 (1) TFEU is carried out on the basis of Regulation (EC) No. 1/2003 by the EU Commission and the competition authorities of the member states. In this context, leniency programs play an important role as investigative instruments.
The thesis deals with problems resulting from the decentralized enforcement of antitrust law in the European Competition Network (ECN) for the use of leniency programs and their possible effects on the effective and coherent enforcement of the prohibition of cartels. In addition, the leniency programs of the Commission, Germany and the United Kingdom are examined in a comparative legal analysis.
