Description
The cryopreservation of human germinal material has increased considerably in reproductive medicine in the past, while the law has lagged far behind this medical progress. Therefore, there is a considerable uncertainty regarding the legal treatment of cryopreservation, which is reflected not least in divergent court decisions. This paper examines the existing laws regarding the harvesting, storage and use of germinal material and highlights the conflict between law and medicine through a critical analysis. On this basis, a proposal for a possible revision of the law on the handling of cryopreserved human germ material is developed.
