Description
The Markets in Crypto-Assets Regulation (MiCAR) has created specific rules for the crypto market in the EU. These also include regulations prohibiting market abuse. In future, these are to be referred to by the criminal provisions of the Crypto Markets Supervision Act (KMAG). Against this background, the thesis first examines the extent to which the current criminal law on market abuse applies to trading in so-called crypto tokens. Taking into account the findings, it then critically assesses regulatory options in future legislation and legislative efforts.
