Can crypto assets be confiscated under current law? In order to answer this question, after a brief technical introduction, the thesis presents the various confiscation orders in connection with crypto assets and then explains how these can be enforced. Among other things, solutions are proposed for crypto-asset-specific problems, such as the necessary co-operation of the holder in the transfer of crypto-assets.
In addition, the thesis looks at the realization of confiscated crypto assets and deals in particular with the involvement of a private bank. Finally, it proposes legislative improvements.
