The use of artificial intelligence (AI) in medical diagnostics challenges the existing legal framework and its application to avoid unduly restricting the existing potential for innovation. Against this background, this dissertation provides a practice-oriented assessment of the adequacy and coherence of the AI-related regulatory framework. The focus is on the horizontally structured regulatory instruments of the GDPR and the AI Act, as well as the vertically applicable rules of medical professional law. This thesis examines whether and to what extent there is a need for regulatory clarification and supplementation, and develops interpretive approaches and regulatory proposals for a potentially more adequate regulation de lege ferenda.
