With the advancing development of artificial intelligence, various legal problems arise. From the perspective of data protection law, the lack of transparency of certain types of AI is particularly critical. On the one hand, the author examines whether and under what conditions such systems may be used in a way that is permissible under data protection law. On the other hand, regulatory approaches for a transparent development and use of AI systems are identified, primarily including the controversial question of whether and to what extent data protection law grants the person affected by an AI decision a “right to explanation” of how the system works.
