The relationship between EU and national legislation, as well as the relationship between the European Court of Justice and the German Federal Constitutional Court, has been the subject of various scholarly contributions and judicial decisions. In contrast, the specific significance of state constitutional law in the multi-level system, as well as the role of German state con-stitutional courts in the context of the European system of legal protection, has received hardly any attention to date.
This work offers the first systematic survey of the existing case law of state constitutional courts with regard to the question of whether and how they enforce EU legislation. Furthermore, the normative requirements of the various regulatory levels are established in several steps while taking into account their interrelations. The previous jurisdiction of the state constitutional courts is consulted on the basis of the results.
