Description
The Liber Amicorum covers 48 contributions in German, English and French which had likewise been subject of a conference held in Rostock.
The contributions have been grouped together in four parts. Part I centres around the theoretical concept of rights and diffuse interests in the European legal order. Part II treats the leading principles of the European legal order, the problems resulting from differing legal cultures, the necessity to elaborate genuine patterns of justice and the need to develop a European "Code de la Consommation" as possible predecessor for a European private law. Part III helps to understand the role and function of diffuse interests in competition law, misleading and unfair advertising, in labour law and social security, in contract and tort law, in environmental law, in products safety law and in data protection. The value of subjective rights in the European legal order depends on their enforceability. Under the heading of access to justice transborder consumer litigations as well as dispute settlement procedures are discussed.
The Liber Amicorum provides an overview on the European legal order in the process of being transformed to an economic and social constitution.
