Massenüberwachung von Finanzdaten

Digital surveillance measures to combat money laundering and terrorism have so far remained in the shad-ows of jurisprudence and case law. This is surprising, given the extensive German and European case law, the so-called 'constitutional security law', that has developed in recent years, particularly in relation to the reten-tion of telecommunications data and the analysis of passenger data. This work aims to fill that gap and include anti-money laundering measures in the general discussion relating to surveillance and security. It presents the principles of constitutional security law, which is characterised by case law, and examines its dogmatic background and developments. On this basis, it speculates on whether the current system of monitoring financial transactions meets the complex requirements of fundamental rights.
