Over the past two decades, the world's five largest digital companies have made numerous acquisitions without any merger being prohibited by the European Commission or the German Federal Cartel Office under merger control. In retrospect, many of these transactions are considered to be highly problematic from a competition perspective.
Based on the competitive economic characteristics of digital platform markets and the specific acquisition strategies of large digital companies, this paper analyzes the suitability of the SIEC test in European and German merger control law. Solutions are discussed both de lege lata and de lege ferenda.
