Description
The dissertation addresses the conflict of competence between European and national regulation of intermediaries. First, the changes in communication caused by digitalization are examined. In a next step, the regulatory legal framework in the multi-level system of the European Union is analyzed. Both the DSA, the P2B Regulation and the MStV attempt to address the threats posed by algorithmic information brokering through transparency and non-discrimination provisions. Due to overlaps in the content of the regulations, a tension arises in terms of jurisdiction, which is ultimately resolved in favor of European law due to the primacy of application.
