Memes versus Uploadfilter

The book examines both existing and desirable dimensions of user protection under the German UrhDaG within the framework of platform regulation under Article 17 of the DSM Directive. Specifically, the possibilities for users of online platforms to enforce their rights in cases where copyright-compliant content is blocked automatically are brought into focus. The aim is to contribute to the debate of whether copyright law in the digital environment is capable of providing a sufficient balance of interests between right holders, service providers, and users. In addition to Article 17 and its implementation in the UrhDaG, the analysis also considers relevant national provisions and the regulatory influence of the Digital Services Act.
