Menschenrechtskonformes Staatshaftungsrecht

The law responds to legal violations in order to ensure its effectiveness. This is also true of the ECHR. This book examines the nature of these responses to violations under the ECHR and, in its first part, develops a dogmatic framework for the right to reparations under the Convention, based on an analysis of the relevant provisions and the case law of the European Court of Human Rights. The second part then addresses the question of how these requirements can be implemented within the context of German state liability law. To this end, the constitutional and legal foundations in German law in general are examined in detail, with the aim of ultimately presenting a proposal grounded in methodology and legal doctrine.
