Description
This study examines the background, regulatory effect and constitutionality of the “Mietpreisbremse” (rent regulation) and the “Bestellerprinzip” (“Principal Pays”-Principle). With regard to their backgrounds, it is worked out what the causes of the imbalance on the above-mentioned housing markets are and which (accompanying) measures can be taken targeting these causes. The regulatory effect has to be seen in the fact that general welfare goals are pursued by means of private law legislation. The focus of the study is on the constitutionality of such an approach and of the two legal institutions examined.
