The first ‘Dialog Internationales Familienrecht’, a conference on international family law, was held in Münster in April 2018. Under the heading of ‘Migration and PIL’, scholars and practitioners confronted the challenges resulting from the particular living situations of refugees and migrants under both procedural and substantive international family law. This publication compiles the lectures held at the conference. The contributions deal with, inter alia, the definition of a refugee in the Geneva Convention on Refugees, the treatment of underage refugees under family law, the localisation of a refugee’s habitual residence, the effects of refugee status on jurisdiction and choice of law clauses, polygamy and other prohibited aspects of marriage, the term ‘child’ in international family law as well as the risks of a choice of law in family and inheritance law. The publication is completed with thoughts on child welfare and international jurisdiction regarding underage refugees.
