This work is the first comprehensive study of the German criminal law on migration from a legal-scholarly perspective. It offers a critical analysis of the historical development, current structure, and social implications of the criminalization of migration brought about by the criminal provisions of the Residence Act, the Asylum Act, the Freedom of Movement Act, and the Nationality Act. The central question is to what extent the use of criminal law to enforce the rules of the administrative migration law can be justified , and which constitutional, EU, and international legal limits constrain such use. In addition, the author offers a comprehensive proposal for legislative reform, giving new impulses for the legal policy debate.
