Minderjährigenehen in Deutschland

In the course of increasing immigration to Germany, the issue of marriages of minors has come into focus. The legislature has reacted to the apparently increasing phenomenon of "minors' marriages" with the law to combat child marriages. The Federal Court of Justice considers the newly introduced Art. 13 para. 3 no. 1 EGBGB to be unconstitutional and has submitted the issue to the Federal Constitutional Court. Accordingly, the key question of the present analysis is: Is the law to combat child marriages compatible with the requirements of the constitution, European and international law? By examining and comparing the old and current legal situation regarding the treatment of marriages of minors in Germany, recommendations on the legal situation de lege ferenda are presented.
