Mindeststandards der Verteidigung in einem künftigen Verbandsstrafrecht

This work derives minimum defense standards in criminal proceedings from Constitutional and European law, which must inform the design of future corporate criminal law. The debate on introducing national criminal liability for associations or companies—so far focused mainly on whether such a law should exist—is thus broadened to include a procedural perspective. The specific challenges posed by the structure of legal entities are analyzed to meet constitutional requirements and develop coherent solutions. Based on these findings, the draft Corporate Sanctions Act (VerSanG), which was not enacted by the end of the 19th legislative period of the Bundestag, is critically assessed.
