Missbrauchskontrolle im TK- und Energiesektor zwischen Regulierung und kommunalem Handeln

The susceptibility to monopolies and the objective of maintaining workable competition in the network sectors require effective control of the abuse of market power – especially regarding network infrastructure. At the same time, ever more comprehensive requirements for network expansion are imposed. Relevant actors in the field of network infrastructure are not only private corporations and the federal government but also municipalities – both in broadband expansion and the award of energy concessions.
This work provides a comprehensive and comparative look at this mixture of actors, specifications, and interests and illustrates inconsistencies and the need for reform – in particular by drawing on insights from legal practice in both sectors.
