Missbrauchsverbot als Durchsetzungsinstrument

The study touches on the interplay between data protection unfair competition, unfair terms and antitrust law. In light of the Bundeskartellamt's proceedings against Facebook the study examines to which extent the provisions of inter alia data protection and unfair competition can serve as a yardstick for abuse of control. Consequentially it is asked whether such application of antitrust law can help overcome enforcement deficits in other fields of the law. Thus the work concerns the important policy question of how to correctly regulate the digital economy.
