What are the responsibilities of the party not bearing the burden of proof for establishing the facts of the case in civil proceedings? Many answers to this question still refer to the supposed principle that no party is obliged to provide the opponent with the material for its victory. Starting from an examination of the basic principles of fact-finding in civil proceedings, the thesis is devoted to the pleading standards of the parties and disclosure obligations of the opposing party. As a result, a stronger co-responsibility of the party not bearing the burden of proof is advocated, while at the same time safeguarding its legitimate interests.
