Modifikationen des Insolvenzplans

Insolvency plans are based on forecasts that may become invalid due to changes in actual circumstances. This thesis examines the resulting need for plan modifications and analyzes their legal admissibility at every stage of the insolvency proceedings. In doing so, it highlights the tension between the expeditious conduct of the proceedings and the transparency of such modifications for the parties affected by the plan. Among other matters, the author critically engages with §§ 221, 231, and 240 of the German Insolvency Code and examines the scope for influencing insolvency plans following their judicial confirmation. On this basis, the thesis develops nuanced approaches towards a more flexible treatment of insolvency plan modifications.
